Terms of Service

These Terms of Service form a binding agreement between you and GroupGiftGo. By accessing GroupGiftGo.com, creating an account, contributing to a gift fund, calling our automated phone system, or otherwise using our services, you agree to these Terms.

If you do not agree, do not use the services.

These Terms use the following words:

• Retailer — a business that uses GroupGiftGo to offer group gifting to its customers.
• Gift fund — a campaign created to collect contributions toward a specific product or amount.
• Contributor — a person who gives money toward a gift fund, online or by telephone.
• Recipient — the person a gift fund is created for.

Some sections apply only to Retailers and say so. Everything else applies to everyone using the services.

GroupGiftGo provides:

• Creation and hosting of gift fund pages with shareable links.
• An automated telephone (IVR) contribution system, so that a contributor can call a number, enter a gift fund code, and pay by card without a smartphone or internet access.
• A retailer dashboard for tracking funds, contributions, and reporting.
• Checkout integration that applies a completed fund to a purchase through a redemption code.

We may change, add, or remove features. We will give reasonable notice of changes that materially reduce functionality a Retailer is paying for.

You must be at least 18 years old and able to form a binding contract to use GroupGiftGo. If you use the services on behalf of a business, you represent that you are authorized to bind that business to these Terms.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at [email protected] or 855-926-8324 if you suspect unauthorized use. We are not liable for losses arising from your failure to safeguard credentials.

Contributions are collected through PCI-DSS compliant payment processors. By contributing, you authorize the charge shown at the time of the contribution, including any disclosed fees.

A contribution is a payment toward the gift fund it is made to. GroupGiftGo is not the seller of the underlying product. The Retailer is responsible for the goods or services purchased with a completed fund, for their description, availability, delivery, and for any warranty.

Fees for Retailers are set out in the written quote or order form agreed with us. All amounts are in US dollars unless stated otherwise, and are exclusive of taxes unless stated otherwise.

Refund eligibility depends on the Retailer’s policy for the gift fund you contributed to, and on the status of the fund. Contact the Retailer first, or contact us at [email protected] and we will help direct your request.

If a gift fund is cancelled before it completes, or does not reach its goal within the period the Retailer has set, contributions are handled according to the terms shown on that fund page, which may include a refund to the original payment method or the release of the balance to the recipient.

Unclaimed balances are handled in accordance with applicable unclaimed property law.

These terms govern the GroupGiftGo Alerts messaging program. They apply in addition to the rest of these Terms.

Consent. We send messages only to numbers whose owner has given prior express consent, and we keep a record of that consent. Consent to receive marketing text messages is not a condition of purchasing any goods or services. You represent that you are the subscriber or customary user of any mobile number you give us, and that you are authorized to consent for that number.

Opting out. Opt-out requests are honored promptly. After you send a stop keyword, we will send a single confirmation message and then stop sending messages to that number under this program. You may rejoin at any time by opting in again.

Carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, Boost, Cricket, MetroPCS, and other carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is outside our control.

Changing or reassigning your number. If you give up or change a mobile number you have enrolled, you agree to notify us so we do not message the number’s next owner. Tell us at [email protected] or 855-926-8324.

How we handle mobile numbers and consent data, including our commitment never to share them with third parties or affiliates for marketing purposes, is described in our Privacy Policy.

Contributions made by telephone are processed through our automated phone system. You are responsible for any charges your telephone provider applies to the call.

Calls may be monitored or recorded for quality assurance, training, fraud prevention, and record-keeping, and we disclose this at the start of the call. If you prefer not to be recorded, end the call and contribute online instead. Card numbers entered on your keypad are passed directly to our payment processor and are suppressed from recordings.

This section applies to Retailers. If you use GroupGiftGo with your own customers, you must:

• Obtain and document any consent required before a customer’s telephone number is used for calls or text messages, and honor opt-out requests you receive directly.
• Comply with all laws that apply to your use of the platform, including the Telephone Consumer Protection Act, applicable state telemarketing and privacy laws, and carrier and industry messaging rules.
• Publish your own privacy notice and make it available to your customers.
• Refrain from uploading or messaging contact lists purchased or obtained from third parties or lead generators.
• Describe your gift funds, products, refund terms, and delivery expectations accurately.

Failure to meet these obligations is grounds for immediate suspension, because it puts the messaging and payment capability that all Retailers depend on at risk.

You agree not to:

• Use the services for any unlawful, deceptive, or fraudulent purpose.
• Send or solicit messages in any category prohibited by carriers or by law, including messages relating to illegal substances, hate speech, harassment, high-risk financial offers, or adult content.
• Impersonate any person or entity, or misrepresent your affiliation with one.
• Create gift funds for products or causes you are not authorized to represent.
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the platform.
• Use automated means to scrape or harvest data from the services.

The GroupGiftGo platform, including its software, design, and content, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the services in accordance with these Terms.

Retailers keep ownership of their own trademarks, logos, and content, and grant us the limited right to display them for the purpose of operating branded gift fund pages and providing the services.

The services rely on third parties, including payment processors and telecommunications providers. Your use of those services may also be subject to their terms. We are not responsible for the acts or omissions of third parties, or for interruptions caused by them.

The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, timely, secure, or error-free, or that every message or call will be delivered.

To the fullest extent permitted by law, GroupGiftGo will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the services.

Our total liability for any claim relating to the services will not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You agree to indemnify and hold harmless GroupGiftGo and its officers, employees, and agents from any claim, loss, liability, or expense, including reasonable legal fees, arising from your use of the services, your violation of these Terms, or your violation of any law or third-party right. This includes claims arising from calls or messages sent without the consent required by law.

We may suspend or terminate access to the services if you breach these Terms, if we are required to do so by law or by a carrier or payment partner, or if we reasonably believe continued access creates risk to other users or to the platform. You may stop using the services at any time. Terms that by their nature should survive termination will survive it.

These Terms are governed by the laws of the United States and of the state in which GroupGiftGo is organized, without regard to conflict of law principles.

Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty days.

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, give additional notice. Continued use of the services after changes take effect means you accept the revised Terms.
